I. General Provisions

The controller for personal data within the meaning of Art. 4 No. 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: “GDPR”) is SALDERA s.r.o., ID No. 27769216, with its registered office in Čeladná 287, 73912 (hereinafter: “Controller”).

Personal data is all information that relates to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  4. The Controller has not appointed a data protection officer.

II. Sources and Categories of Processed Personal Data

  1. The Controller processes personal data that you have provided to it or that it has received based on the fulfillment of your order.
  2. Processed data includes your identification and contact details, as well as data necessary for contractual performance.

III. Legal Basis and Purpose of the Processing of Personal Data

  1. The legal basis for processing is:
  • the performance of the contract between you and the Controller pursuant to Art. 6 Para. 1 lit. b GDPR,
  • the legitimate interest of the Controller in direct marketing (in particular the sending of business communications and newsletters) pursuant to Art. 6 Para. 1 lit. f GDPR,
  • your consent to processing for direct marketing purposes (in particular the sending of business communications and newsletters) pursuant to Art. 6 Para. 1 lit. a GDPR in conjunction with Section 7 Para. 2 of Act No. 480/2004 Coll. on certain information society services, if no order for goods or services has been placed.
  1. The purpose of processing is:
  • the processing of your order and the assertion of rights and obligations arising from the contractual relationship between you and the Controller; in the case of an order, personal data is requested that is necessary for successful processing (name, address, contact); the provision of this data is a prerequisite for the conclusion of the contract and its fulfillment – without it, no contract can be concluded or fulfilled,
  • the sending of business communications and the implementation of other marketing activities.
  1. Automated individual decision-making within the meaning of Art. 22 GDPR does not take place. Such processing only occurs with your express consent.

IV. Data Retention Period

  1. The Controller stores personal data:
  • form the duration necessary to satisfy the rights and obligations arising from the contractual relationship between you and the Controller, as well as for the assertion of claims arising from this relationship (15 years after the end of the contract),
  • until the withdrawal of consent to processing for marketing purposes, but for a maximum of 3 years, provided the processing is based on consent.
  1. After the retention period has expired, personal data will be deleted.

V. Recipients of Personal Data (Processors)

  1. Recipients of personal data are:
  • persons involved in the delivery of goods / services / payment processing,
  • service providers for the operation of the online shop and related services,
  • service providers in the field of marketing.
  1. The Controller does not intend to transfer personal data to third countries (outside the EU) or international organizations. Recipients in third countries include, for example, providers of mailing services or cloud services.

VI. Your Rights

  1. Under the GDPR, you have the following rights:
  • Right of access pursuant to Art. 15 GDPR,
  • Right to rectification pursuant to Art. 16 GDPR or to restriction of processing pursuant to Art. 18 GDPR,
  • Right to erasure pursuant to Art. 17 GDPR,
  • Right to object to processing pursuant to Art. 21 GDPR,
  • Right to data portability pursuant to Art. 20 GDPR,
  • Right to withdraw consent to processing in written or electronic form to the contact details mentioned in Article III.
  1. Furthermore, you have the right to lodge a complaint with the data protection authority if you are of the opinion that your data protection rights have been violated.

VII. Data Security Requirements

  1. The Controller declares that it has taken all appropriate technical and organizational measures for the protection of personal data.
  2. It has implemented technical measures for the protection of data in electronic and written form, in particular antivirus protection, passwords, HTTPS connections, etc.
  3. The Controller declares that personal data is only accessed by authorized persons.

VIII. Final Provisions

  1. By submitting the order via the online order form, you confirm that you are familiar with the data protection conditions and accept them in full.
  2. By checking the consent box in the online form, you agree to the data protection conditions and confirm that you have read and accepted them in full.
  3. The Controller reserves the right to change these conditions. The new version will be published on its website and sent to you at the email address you have provided.

These conditions take effect on October 26, 2023.
